1. Introduction

These Terms & Conditions ("T&C") govern your use of Replik ("Platform," "We," "Us," or "Our").By accessing or using Replik, you ("User") agree to comply with these T&C. If you do not agree, please refrain from using our services. Replik ("We," "Us," or "Our") is committed to protecting the privacy of its users ("You" or "User"). For the purposes of this policy, “Replik” refers to Replik Media Private Limited and includes all associated platforms, products, and services operated by the company, including but not limited to the Stvia.ai application and website.

2. User Eligibility & Account Registration

We collect personal data provided by users when they interact with our platform, including:

Users must create an account to access Replik’s services.
You are responsible for maintaining the confidentiality of your account credentials. Any unauthorized use of your account must be reported immediately.

2.1. No Collection of Sensitive Data

Replik does not collect biometric data, government-issued identification, or other sensitive personal information.

3. Usage Rules & Restrictions

Replik’s services must be used in compliance with the License Policy and applicable laws. Users are prohibited from:

Using AI-generated content for offensive, illegal, defamatory, or misleading purposes.
Creating deepfakes, deceptive representations, or harmful content.
Violating intellectual property laws, including misrepresentation of AI-generated models as real individuals.
Reverse-engineering, modifying, or redistributing Replik’s proprietary AI models.

4. Payment, Credits & Refunds

Users can purchase credits, which are used to generate product catalog content using Replik’s virtual models.
Credits are non-refundable, and no refunds will be provided for unused or expired credits.
Payments are processed securely through Razorpay, and Replik does not store sensitive payment details.

5. Content Ownership & AI-Generated Content

Users retain usage rights to the generated content they create, subject to the License Policy.
Replik retains a non-exclusive right to use AI-generated content for platform improvements, internal research, and marketing (unless explicitly opted out).
No ownership of the AI models, software, or algorithms is transferred to the user.

6. Liability & Indemnification

Users are solely responsible for their use of Replik’s AI-generated content.
Replik shall not be held liable for any misuse, legal violations, or claims arising from the user’s use of the platform.
Users agree to indemnify and hold Replik harmless against any legal actions, damages, or disputes resulting from their use of the platform.

7. Account Suspension & Termination

Replik reserves the right to suspend or terminate accounts under the following conditions:

Violation of these T&C or the License Policy.
Use of the platform for prohibited or unlawful activities.
Attempts to manipulate, hack, or exploit Replik’s services.
Non-compliance with Indian laws, including the Information Technology Act, 2000.

8. Governing Law & Dispute Resolution

Secure servers and encrypted storage for user data.These T&C shall be governed by and interpreted in accordance with the laws of India.
Restricted access controls for internal data handling.Any disputes arising out of or related to the use of Replik shall be subject to the exclusive jurisdiction of courts in Delhi, India.

9. Changes to These Terms

Replik reserves the right to update or modify these T&C at any time. Continued use of the platform constitutes acceptance of the revised terms.

Stvia.ai – Special Terms of Use

By using Stvia.ai, you agree to the following additional terms and responsibilities related to our AI-powered fashion and style assistant:

1. Use of AI-Generated Content

Stvia.ai uses artificial intelligence to generate styling suggestions, wardrobe coordination, and virtual try-on visuals. These outputs are generated based on user inputs and are intended for personal fashion exploration.

We strive for relevance and appropriateness, but AI-generated content may occasionally vary in accuracy. We disclaim liability for any reliance placed on such outputs.

You agree not to use Stvia.ai to:

Generate or share content that impersonates real individuals in a misleading or harmful way.
Create deepfakes, offensive visuals, or deceptive representations.
Distribute or misuse generated content for unlawful or unethical purposes..

Stvia.ai uses internal moderation and filtering mechanisms to limit inappropriate, abusive, or misleading outputs.

2. Child Safety and Endangerment Policy

Stvia.ai takes the protection of children extremely seriously. You may not use the platform in any way that could:

Exploit, endanger, or profile minors inappropriately.
Generate, upload, or distribute content involving children in sexualized, harmful, or unsafe contexts.
Use AI-generated visuals to depict minors in any deceptive or manipulated fashion.

We prohibit all content that may harm or misrepresent minors—whether uploaded by users or generated via the AI system. Violations will result in immediate account suspension and may be reported to relevant authorities as required.

2.2 Age Restrictions

You must be at least 18 years old to access or use Replik’s services, including Stvia.ai. We do not knowingly permit individuals under the age of 18 to create an account or use the platform. If a parent or legal guardian wishes to use our services on behalf of a minor, they may do so at their own discretion and are fully responsible for all activity, data, and interactions made through their account. Replik disclaims liability for any misuse or unauthorized access by minors.

If you come across content that may put a minor at risk, please report it immediately via support@thereplik.com.

3. In-App Credits and Transactions

Stvia.ai includes in-app credits for features like virtual try-ons, wardrobe analytics, and personalized product discovery. Credits are purchased through secure third-party platforms and are non-refundable, except where required by law or due to system errors.

4. Data Ownership and Consent

You retain full ownership of the content you upload, including wardrobe photos and input images. By using the app, you grant Replik a limited, revocable license to process this data for the sole purpose of delivering the requested services.

Input/output images are temporarily stored and deleted after processing unless you explicitly choose to retain them.
We do not reuse or share user-generated images for training, promotion, or third-party use without explicit consent.

5. Location Data Use

We may request access to your location to:

Suggest region-specific fashion trends
Recommend weather-based outfit ideas
Help discover nearby retailers or styling services

Location data is never sold or permanently stored and is used only to personalize your experience in the app.

6. Prohibited Use

You may not use Stvia.ai to:

Upload or request generation of offensive, exploitative, or misleading content
Circumvent our safety and moderation systems
Harass or target individuals or communities using AI outputs
Promote harmful behavior, including body shaming or unrealistic depictions

Accounts in violation of these policies may be restricted or terminated, and content may be removed without notice.
