1. Introduction

By using Replik, you agree to comply with this Policy and all applicable laws, including relevant provisions under Indian law.

2. Scope of License

Replik grants users a non-exclusive, non-transferable, revocable, and limited license to access and use the platform to generate AI-powered fashion content, subject to the terms of this Policy.

Users may utilize Replik's services for:

Displaying and distributing AI-generated content for personal or business purposes, provided compliance with these terms is maintained.

2.2. Restrictions on Use

Users shall not:

Resell, sublicense, lease, or otherwise distribute the generated content as standalone assets or as part of any stock media repository.
Use the generated content in a manner that infringes upon third-party intellectual property rights.
Modify, reverse-engineer, or attempt to extract the underlying AI models or datasets used by Replik.tent for personal or business purposes, provided compliance with these terms is maintained.
Use Replik’s services for unlawful, defamatory, obscene, misleading, deceptive, or unethical purposes.
Generate misleading content that falsely represents real individuals or misuses AI-generated likenesses.

3. Model Selection and Liability

Replik allows users to generate content featuring various virtual models, some of which may be available at a premium.

User Responsibility: Users are solely responsible for ensuring that their generated content complies with applicable laws and ethical standards.
No Platform Liability: Replik does not claim responsibility for how users utilize AI- generated content.
User Liability: Any misuse of the platform or generated content is the sole liability of the user.

3.1. Disclaimer on Virtual Model Likeness

The virtual models provided by Replik are AI-generated and do not represent real individuals.
Users must not imply or misrepresent that the AI-generated models are real individuals or celebrities.

4. Ownership and Intellectual Property Rights

4.1 Replik&'s Intellectual Property

All software, AI models, website content, and other proprietary materials belong to Replik.
Users do not acquire ownership of the AI models, algorithms, or the technology underlying Replik.

4.2 User-Generated Content

Users retain rights to the AI-generated content they create, subject to Replik’s licensing restrictions.
Replik retains a non-exclusive, worldwide license to use user-generated content for platform improvements, marketing, and research purposes unless explicitly opted out.

5. Premium Models and Licensing

Certain AI models may be available at a premium price. The use of such models is subject to:

Additional Licensing Fees: As specified at the time of purchase.
Limited Usage Rights: Which may restrict modifications, redistribution, or commercial applications beyond the specified terms.
No Exclusivity or Ownership Transfer: Users do not receive exclusive rights or ownership of the premium AI models.

6. Accountability and Liability

Platform Liability: Replik does not assume liability for any misuse of its platform or generated content.
Indemnification: Users agree to indemnify and hold harmless Replik from any legal claims, damages, or disputes arising from their use of the platform.

7. Legal Compliance & Indian Law Considerations

Users must comply with the following Indian laws:

Information Technology Act, 2000: Including provisions such as Section 66D (Punishment for Cheating by Impersonation using Computer Resource) and Section 67 (Prohibition of Publishing Obscene Material).
Indian Copyright Act, 1957: Protecting original works of authorship, including aspects of AI-generated content.
Consumer Protection (E-Commerce) Rules, 2020: In case of commercial use. Replik reserves the right to suspend or terminate accounts violating Indian or international laws.
